1. About these terms

These terms of service ("Terms") govern your use of the Jeanette AI service ("Service") operated by RCF Ltd, a company registered in England & Wales (Company No. 06404284) with its registered office at 247 Church Street, London, N16 9HP ("we", "us", "our").

By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

2. The Service

Jeanette AI is a conversational AI assistant accessible via messaging platforms such as WhatsApp and Telegram. The Service can perform tasks on your behalf, including browsing the web, managing calendars, sending emails, and interacting with third-party services you connect.

The Service is provided "as is". While we strive for reliability and accuracy, AI-generated outputs may contain errors or inaccuracies. You are responsible for reviewing and verifying any actions Jeanette takes on your behalf.

3. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you confirm that you meet this age requirement.

4. Your account

Your account is identified by your phone number or messaging platform identity. You are responsible for all activity that occurs through your account. Keep your messaging account secure and notify us if you suspect unauthorised use.

5. Acceptable use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Send spam, phishing messages, or unsolicited communications through connected services.
• Attempt to access other users' data or accounts.
• Generate content that is illegal, harmful, abusive, or infringes on the rights of others.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Use the Service in a way that could damage, disable, or impair its operation.

We reserve the right to suspend or terminate access for violations of these terms.

6. Connected services

You may connect third-party services (e.g. Google Calendar, Gmail, Notion) to Jeanette. When you do so, you authorise us to access those services on your behalf to carry out your instructions. You are responsible for ensuring you have the right to grant this access and for the consequences of actions taken through those services.

We are not responsible for the availability, accuracy, or policies of third-party services.

7. Subscriptions and payments

Access to certain features of the Service requires a paid subscription or credit purchase. Prices are displayed before purchase. Payments are processed by Stripe and are subject to Stripe's terms of service.

Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You can cancel your subscription at any time through the dashboard or by contacting us. Cancellation takes effect at the end of the current billing period.

Refunds are handled on a case-by-case basis. If you believe you have been charged in error, contact us at support@jeanette.ai.

8. Credits

Credits are consumed when Jeanette performs certain actions (e.g. web browsing, image generation, API calls). Credits are non-transferable and non-refundable. Unused credits do not expire while your account remains active. We reserve the right to adjust credit costs for specific actions with reasonable notice.

9. Intellectual property

You retain ownership of any content you provide to the Service. We retain all rights in the Service itself, including its software, design, and branding.

You grant us a limited licence to use your content solely as necessary to provide the Service to you.

10. Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, or that AI outputs will be accurate or complete. You acknowledge that AI systems can produce incorrect, misleading, or inappropriate outputs.

11. Limitation of liability

To the fullest extent permitted by law, RCF Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages (including legal fees) arising from your use of the Service, your violation of these Terms, or actions taken by the Service at your direction through connected third-party services.

13. Changes to the Service or Terms

We may update these Terms from time to time. We will notify you of material changes through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

We may also modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

14. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. On termination, your right to use the Service ends immediately. We will delete your data in accordance with our Privacy Policy.

15. Governing law and disputes

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
